Terms of Service

1. Scope and provider

These Terms of Service ("Terms") govern your use of the DynSVG website and editor tool available at dynsvg.io ("Service"). By using the Service you agree to these Terms. If you do not agree, you may not use the Service.

The provider of the Service is identified in the Imprint.

2. Description of Service

DynSVG is a browser-based SVG binding editor for Siemens WinCC Unified and WinCC V8+. It allows users to upload SVG files, bind parameters to element attributes, simulate behaviour, and export production-ready .svghmi files.

The editor runs entirely in your browser and the files you open are never uploaded to our servers. Loading an SVG and creating bindings require no account. Running the simulation, exporting a .svghmi file and viewing the generated XML require a free account.

3. Free tier — licence and usage restrictions

The free tier of DynSVG is provided for personal and educational use only. By using the free tier you agree to the following restrictions:

  • Exported .svghmi files may not be used for commercial purposes.
  • Commercial purposes include, but are not limited to: integration into commercial products or systems, use in paid client projects, deployment in production environments operated for commercial gain, and resale or redistribution of exported files.
  • The free tier is limited to a maximum of 3 bindings per widget.

Commercial use of exported files requires a paid Pro subscription, which lifts these restrictions for as long as it is active — see Section 4. If you are unsure whether your intended use qualifies as commercial, please contact us before using the exported files.

4. Pro subscription — licence, prices and VAT

Paid plans are not yet available. No subscription can currently be ordered and no payment is taken. Sections 4 to 11 describe the paid plan and apply from the date paid plans become available; until then only the free tier exists, and Section 3 governs your use.

A paid Pro subscription grants you, for as long as it is active, a non-exclusive licence to use the Service and the files you export from it for commercial purposes, and removes the free tier's limit of 3 bindings per widget. The restrictions in Section 3 do not apply while your subscription is active.

When a subscription ends, your account returns to the free tier and the restrictions in Section 3 apply again. Files you exported while your subscription was active remain licensed for commercial use permanently; that licence is not revoked when the subscription ends. The restrictions apply again only to files you export afterwards.

Prices. Pro is available with a monthly or a yearly billing interval. The current price of each interval is shown on our pricing page and again in the checkout before you place your order.

VAT / USt. All prices are gross prices and include statutory value added tax. Paddle (see Section 7) determines, displays, collects and remits the value added tax applicable to your country.

This Section licences the commercial use of the Service and its exports and the removal of the binding limit. Features described elsewhere on this site as planned or coming soon are not part of what a subscription promises today.

5. Conclusion of contract

The presentation of the plans on our website is not a binding offer. It is an invitation to you to place an order.

A subscription is taken out as follows: you sign in to your account, choose the monthly or the yearly interval (on the pricing page, on your account page, or in the editor when you reach the free-tier limit), and a checkout overlay operated by Paddle opens. You enter your payment details there and place a binding order in that overlay. The contract is concluded when your order is accepted and the payment is confirmed; your account is switched to Pro immediately afterwards.

Your contract for the subscription is concluded with Paddle as Merchant of Record, not with the provider named in the Imprint, and Paddle's buyer terms govern the sale. The provider licenses the Service to you on the terms set out here.

The contract language is English or German. These Terms are available on this page at all times and can be printed or saved.

6. Subscription term, renewal and billing

The subscription runs for the interval you chose — one month or one year. It renews automatically for a further interval of the same length at the end of each billing period, at the price then in effect, until it is cancelled in accordance with Section 10. There is no minimum term beyond the interval you booked.

Payment is due at the start of each billing period and is collected by Paddle from the payment method you provided at checkout. The renewal date of your current period is shown on your account page.

7. Paddle as reseller and Merchant of Record

Paid subscriptions are sold and invoiced by Paddle.com Market Limited, acting as reseller and Merchant of Record. Paddle, not the provider named in the Imprint, is the seller shown on your invoice, and Paddle handles value added tax.

Paddle issues your invoice and makes it available to you; the payment methods offered to you are those Paddle supports for your country. We never receive or store your card or bank details — see our Privacy Policy.

8. Right of withdrawal for consumers

If you are a consumer within the meaning of § 13 BGB, you have a statutory right to withdraw from a distance contract within 14 days pursuant to § 355 BGB. The period begins on the day the contract is concluded. Section 9 contains the statutory instructions on withdrawal and the model withdrawal form.

A Pro subscription gives you access to a paid digital service immediately after the contract is concluded, that is, before the withdrawal period has expired. In that situation the right of withdrawal can lapse only if you have expressly requested that performance begin before the end of the withdrawal period and have confirmed that you are aware of losing the right of withdrawal once the service has been fully performed (§ 356(4) BGB).

9. Instructions on withdrawal and model withdrawal form

9.1 Instructions on withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us — Niklas Kappes, Freiherr-von-Drais Str 36, 69429 Waldbrunn, Germany, contact@dynsvg.io — by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form in Section 9.2 for this purpose, though it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments we have received from you without undue delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this repayment.

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of withdrawal, compared with the total scope of the services provided for in the contract.

Because Paddle concludes the sale as Merchant of Record, Paddle processes the reimbursement. A withdrawal notice sent to the address above is effective; we will forward it to Paddle without delay.

9.2 Model withdrawal form

10. Cancellation

You can cancel a Pro subscription at any time with effect from the end of the current billing period, without giving a reason and without a notice period. Sign in, open your account page and use "Cancel subscription". Your subscription then keeps running until the renewal date shown on that page; after that date your account returns to the free tier and the restrictions in Section 3 apply again.

You can also cancel by email to contact@dynsvg.io, stating the email address of your account.

Deleting your account (Section 13) cancels an active subscription immediately rather than at the end of the paid period. Any refund of the unused remainder follows Paddle's refund policy (Section 11).

11. Refunds and price changes

Refunds. Refunds are processed by Paddle as the seller of record. The refund policy that applies is Paddle's, as shown to you in the checkout and set out in Paddle's buyer terms; we do not operate a separate policy alongside it.

Your statutory rights are not affected by any refund policy — in particular the right of withdrawal under Section 8 and your rights in the event of defects.

Price changes. We may change the price of a subscription with effect from the start of a future billing period. We will inform you by email at least six weeks before the change takes effect. If you do not accept the new price, you may cancel under Section 10 with effect from the end of the current billing period. The current billing period is always charged at the price that applied when it started.

12. Intellectual property

The Service — including its user interface, source code, branding, and documentation — is the intellectual property of the provider and is protected by copyright and other applicable laws.

You retain full ownership of the SVG files you upload and the binding configurations you create. The exported .svghmi files are your work, subject to the usage restrictions set out in Section 3 and the licence granted in Section 4.

13. Accounts

Editing is account-free: the drawing you work on is processed locally in your browser. An account is required only to export a .svghmi file or to view the generated XML. Accounts are created by email sign-in link — there is no password. You can delete your account at any time from the account page, which also removes the data associated with it and cancels any active subscription immediately (Section 10).

14. Newsletter and email collection

If you voluntarily provide your email address (e.g. for a waitlist or newsletter), it will be processed in accordance with our Privacy Policy. You may withdraw your consent and unsubscribe at any time.

15. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that exported files will be compatible with any specific version of Siemens WinCC Unified, WinCC V8+, or TIA Portal.

For paid subscriptions, your statutory rights in respect of defects in digital products (§§ 327 ff. BGB) are not affected by this Section.

16. Limitation of liability

To the fullest extent permitted by applicable law, the provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to damages from data loss, use of exported files, or service interruptions.

This limitation of liability does not apply to damages caused by intentional misconduct or gross negligence, or to liability that cannot be excluded or limited under applicable German law.

17. Free tier limitations

The free tier is currently limited to 3 bindings per widget. We reserve the right to modify free tier features, limits, or availability at any time without prior notice.

18. Modifications to these Terms

We reserve the right to modify these Terms at any time. The updated Terms will be published on this page. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

If you have an active paid subscription, we will inform you by email before material changes to these Terms take effect for that subscription. If you do not accept them, you may cancel under Section 10.

19. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law provisions. The place of jurisdiction is the registered location of the provider as stated in the Imprint.

If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
